Hi, I bought a car earlier this week from a dealership, its a 2004 reg - it was advertised as with FSH. The day that I went in to get it they said the service book was in the building in a drawer.

When I went to pick it up (so I had signed to purchase it by now) they said they were unable to find the service book so were going to get in touch with the garages that had done the services and get a replacement for me.

Thats the last I heard - now when I ring the person dealing with it is "busy" but never rings back despite leaving messages.

Have they sold me the car under false pretences and where do I stand?

Private or Dealer sale? And do you still have a copy of the advert?

If it was advertised as having a FSH and hasn't then yes its been sold under false pretences - but the approach to how you deal with it could be different between private and dealer sale - hence my question...

return car forthwith..misssold id say.....contact trading standrds with copy of original advert and let them take it from there...

Bought from a Dealer, advert has been removed from their website now though.

So basically all I have is their word that it did have FSH.

Have the receipts for the 3rd year service - they were in the pile of stuff they gave to us when we bought it, plus they did one when I bought it. Thanks for your replys Smile

Take it back and insist that you either get the FSH or your money - also say you will be in touch with local Trading Standards about false advertising...

Was it in one of the local papers or Autotrader - worth checking if they mentioned FSH?

Hi, thanks for your replys -I'm not sure I am allowed to say their name - is that like libel or something?! Needless to say it is a big, well known company and was a large dealership where they also specialise in certain things for cars.

I rang the garage where the receipts were from this morning - they say they have only ever done one service on it - the big 3 year one, so I guess at least we have that one.

I am not going to let it lie just yet as they just shouldn't be doing this sort of thing, but I suppose I should have got it in writing that they were going to get me the service history if I'd had a bit of sense.

I will let you know the outcome!! Thanks again

quite a lot of garages haven't had a chance too properly examine cars before they advertise them ... can be still in hands of previous owners for example who say they have fsh on the car & then somehow either they mislay it, the garage does etc ..
.. they seem to produce 'generic' ads which have all the standard things mentioned like fsh, tiz a case of buyer beware


why is it when I stand on my head that sometimes, just sometimes ......?

With a private sale I'd agree, Barky, but I don't think its the same if its a dealer - the responsibilities are different I'm sure...

Extended warranty time perhaps?

product that you have purchased does not match the description on the sale particulars therefore they have contravened the sale of goods act. Return the vehicle and insist on the service history being found or a refund, or if you want the car anyway push for a discount.
