Please help, advice needed urgently. Going thru divorce, I stayed in house with children, he pays mortgage but wants to sell it, I don't as not enough profit to buy us another home. So he says he will prove bankruptcy of his business to ensure I don't stay in the house. Mean, I know. This will pay off his 'debts' and get me and the children out. He isn't bankrupt, just crafty. Anything I can do?

I really don't know the legal side regarding his plans scooby and whether or not he can 'force' you out. Have you thought of seeking advive from the Citizens Advice bureau?

Not been in touch with CAB but legally it seems I will not be able to make a claim for any assets at all, even though it means children out of a home and no money. Just hoped someone out there might have any ideas?

as far as I know....he can't sell the house with you in it, but again I would say seek some legal advice.

You need legal advice quickly, but he has a legal duty to make sure the children have a roof over their heads until they are 16 years old. He cannot sell a property from under you. If there is equity in the house there may be a situation whereby you have to sell the house, or buy him out yourself. If you couldn't afford the mortgage on the house, on top of any maintenance or childcare he may pay, then you would have to do this, but you would have to buy another, cheaper property and perhaps review your work status - that is, if you are not working you may have to get a job.

You and your children should not be without a home. You must go to CAB and get the lo down on exactly what you and he are and are not allowed to do. You can also get free advice from a solicitor for first consultation. Good luck Smile

Hi, hate to be a portent of doom but I am in the same situation. The bankruptcy laws stink. Everyone assumes that a wife/ex wife with kids will be looked after - sorry they are not. You have one year to sort out your affairs after which they will take action to evict you. My ex deliberatly went bankrupt to avoid the divorce settlement. The bankruptcy laws overturn any divorce agreement and if you cant buy the ex's half then they will force the sale of the house. I am currently trying to negotiate to keep my house whilst the ex swans off deliberatly not working - the law needs changing to stop it being abused. In the meantime contact an insolvency practioner to get specialist advice as it really is rather complicated! Best of luck.
