That's right. However, at what stage does homo-distaste become homophobia? The panel stated 'any incitement to actual hate crime'. Could this be done with ideolology alone?
Legally, of course people should be allowed to be against homosexuality (providing it is not inciting hatred).
But as a society we should shun attitudes like that in the same way we wouldn't accept people saying they're against black people, disabled people or Jews for example.
It's certainly not a term that we should promote or use, and as style88 said we should discourage attitudes like this. It should be frowned upon by society in a similar way to racism and other bigotry and prejudices. However, making it as politically incorrect as other forms will be hard.
Unfortunately, many people are xenophobic, it seems instilled in us as a natural form of defence. The only way we can unseat these views are through education and awareness, most of the worst homophobic people don't actually know any gay people.
Religion, is also a huge part of the problem, since homosexuality is incongruous with most interpretations. Religion teaches intolerance to homosexuality and since religion is unlikely to change or become accepting anytime soon, if ever, there will always be people that look upon gay people as sinners.
People are free to make their own judgements, and free speech is something I will defend vehemently, even for politically incorrect views and offensive words that many seem to think should be banned. Sadly, it's a fine line between expressing strongly your views, and inciting hatred against your opposition.
maybe what we should ask is what make people homophobic or homo-disaster as used? What right should one have to hate someone different from him or her? i have had to discuss with friends who had been homophobic and they told me that the only reason they have for hating a gay person is that they hear from religious bigot and other enemy of homosexuals over time. Everyday, people that hate and despise gay people spread words about them and most times they are people in authority, important people young people look forward to.
And that reminds me of Boxer the character in Animal Farm that has this saying " if Napoleon says it, its right" for how long are we going to live like that?

If the religious win then we may as well prepare ourselves for being stoned to death.

And that's not just true of gay people - anyone with a desire to explore new ideas and challenge the status quo has always been suppressed by religion.
Look at the way people like Galileo, Shakespeare and Christopher Marlowe were persecuted by the Church - over the centuries, anything that advances humanity, but challenges religion, has been squashed.
It's little wonder that the parts of the world where religion totally dictates people's lives are also the places where people are poorest and least educated.
