Hi, we have just been granted a certificate of lawful use or development for a 24 sqm mobile on some land we own with our property. Now we have been granted this, just wondered what our next step maybe to replace the mobile with a larger one, or for an actual dwelling ? Kind regards Jamie
Hi if you want to replace it I would suggest that you submit a new planning application for the new proposal, but now that you have the Certificate of Lawful Use (which I take is existing and not proposed??) then this will obviously help to provide a better benchmark as you already have an approval for a mobile.
With regards to obtaining permission for a larger mobile unit you really need to obtain planning advice from the duty planner at your council here as there are a number of planning issues which may require consideration particualry if your land is located within any specific land designations.
With regards to swapping the mobile for a dwelling, again it very much depends on where the land is in terms of within a classified built up settlement area or if in a more rural location if it accords with specific policies contained within your council's Local plan/ or UDP as to the location of where new dwellings are appropriate in principle.
If your piece of land happens to be in a location where it is in principle acceptable for a new dwelling, then there will be a number of other material planning considerations which will require further thought such as the design, access and layout of the new property.
