You need to get some documented evidence and then take this into a branch. Don't try to do it over the phone/post you need to see someone face to face so you can explain all the details. When we had a mortgage with them they were always alright with us.

I second Bob- go in there and ask for the money back. The try to fob you off on the phone. My mortgage company took two payments for a valuation- when i was phoning for a refund i was told for 2 weeks that their business unit was looking into it. it's only when i went into my branch and demanded to see the manager they returned the money to me.

I have had nightmares with this H company -they "forgot" to issue my mortgage offer and when I phoned them up to ask why they told me the survey hadnt been done yet (it was done a month before) Finally got my money back - I had to ring my bank and tell them it was a fraudulent payment and claim it back under the direct debit indemnity scheme - but it is back in there now - phew.
I am now dreading completion date on the 14th - what else is going to go wrong now!? This has been the most hellish experiance from start to finish!
I am going to refuse to pay thier 500 pound arrangement fee on the basis that I have had to chase evrystep of arrangement!!

I agree with Bob. You need to do this in writing. Do be careful though of (annoying I know) upsetting your Mortgage Company so close to Completion when they would drop you in it by refusing your Mortgage on the basis of refused payment (unreasonable, yes. Impossible, no). What a nightmare for you. My Mortgage company (Northern Rock) did not take out my first Mortgage Payment until a month after I Completed. They sent me a letter asking for an interim payment to cover the mortgage from my moving in date to the date of my first direct debit payment. This was much better. Nat Let us know how this goes. I've had to chase everything as well- from refunds to mortgage offers. Worse thing is everytime they send me anything I also get a letter offering their sikness/unemployment payment protection!!!! My adviser is totally useless as well- never returns calls. When I told them I wanted to reduce my mortgage and put in more cash she spent 30 minutes trying to persuade me to increase the mortgage (and take out payment protection). Drives me mad!

ooh I have experianced the same thing - the advisor never returened my calls neither does the estate agent who are also the H.
Tried several times to get me to take out the payment protection also - and even signed me up for it despite me saying no and I had to phone them (in ireland??) to cancel it!!

I bet that was a shock!
The system is that the Solicitor TAKES the money from the Mtge Co, and therefore when that happens the Mtge Co believe the mortgage has/will complete on the date advised by the Solicitor. However, Solicitors can and do send the money back, and the Mtge Co should have been aware of that. So it is the Mtge Co that is at fault. Crystal clear?
The H Bank do have the best adverts, and some of the best deals, but their 'back of shop floor' processes are very poor. It's like they will spend loads of money getting your business, but very little maintaining it. Bit like a political party, full of promises running up to the election, and full of excuses after you have voted them in.
A friend of mine used to work for them, she worked for the Leeds B/Soc and they merged with the Halifax. She was invited to a launch party to announce the merger, and was told that to make things as fair as possible, the new name of the company would take one word from The Leeds and one from The Halifax. The new company name was The Halifax. LOL
