Not sure if anybody will know anything about this but i thought i'd ask you anyway.....

Ok, I was at my Sisters house this weekend just checking up on the property as she works away for quite long periods at a time....a few months ago she got new neighbours, a young couple, her daughter and her dogs.

My Sister owns her house, though the one next door is Council owned (as are some others in the Street).

Along the side of the house is a fence (not the panelled type the 'slat' old type) and, on the other side of the fence (in the neighbours are privets.

The young girl is having a fence erected at the back by the Council and she wants to pull the privets down (on her side) and had the cheek to pull me to one-side and say it's my Sisters responsibility to pay for it!!!!!

I told her my Sister is happy with the privets (which they have already cut down to half the size) and why should she pay just because 'the girl' is scared of he dogs getting out!!!!

This girl is a Council Tennant, it irks me that my Sister had to pay for her DG & CH etc but the council recently did most of the others in the street, also that this 17 year old has the cheek to demand payment for a fence.....that my Sister doesn't want!!!!

I don't want to argue with this girl as my Sisters is empty alot and i just don't trust her & her BF!

This is aside her letting her dogs crap all over my Sisters garden....

Does anybody know the way to find out about these things, i assume, if it comes to it i'll have to get her to dig the Deeds out etc....i just can't get over the cheek of her and her attitude, the 'world owes me a living attitude' (i don't think she's worked a day in her life)....

Anybody and useful information that could help before i give her a mouthful....

u have to get the deeds out ,, one side of the fence is only ur sister responiblty..i think it will be the left side that ur sister is response for ,, but best to check it out,,

Check the filed plan at HM Land Registry - if your sister doesn't have a copy they can be downloaded for a small sum. There will usually be marks to denote whose responsibility a boundary is.

As it's a council place next door the local housing office might be interested to know that the tenant is tearing hedges down and erecting fences Wink

Don't tempt me Victoria!!! She was very close to getting a slap with her attitude!!!! Talking about 'that man' cutting the privet (happens to be my Dad), wouldn't mind but they've got a car with no bloody wheels on it stuck in their back garden!!! Arghhhh!

I can see this getting messy!!!!

Honeypot, thanks, i guess we'll have to look at the Deeds, however, the privet is a perfectly fine border, it's just because 'SHE' doesn't like them!!!!

I think if the fence is too the right as you look at the house then its the neighbours fence but if its to the left then the neighbour should not be pulling down the privet.........

LO I am having a similar problem, I am erecting a new fence and my neighbour is anoyed so I have had to get in touch with planing to check the law

This is pretty much how it stands

You can erect a fence 2 metres high measured from the side it is being erected on. Thats 6foot 5 inches

You can have the smooth (Nice) side looking into your garden or away from it, which ever you prefer

You cannot make your neighbour go halves on the fence

You can remove privet hedge etc, BUT you can only put new fence in your own property boundary, it must not be on your neighbours land unless they give permission

It does not matter if the new fence you are erecting doesn't match the old one, as long as it is within the height law

You can enter your neighbours garden for maintainence etc..but you must inform them of your intention first

If the fence is on your land you must make sure it is safe, if it collapses causing injury you will be liable, even if you are a council tenant the person who erected the fence is responsible, not the council

Try googling The Fencing Act 1978 for more info

OR planningportal.gov.uk for all the legal info you need

Hope this helps

If your sister is in any doubt of how she stands legally, she should contact her local planning office immediately, and also write a letter to her neightbour asking that they don't start work until any dispute is settled

Her attitude got me more than anything, demanding my Sister pay for a new fence...from a girl who's lived on benefits since she left School.....

You wouldnt want to inadvertantly make the situation worse for your sis, so i'd say nothing. If pushed, say its none of your business so you dont want to get involved. But in any case, if your sis is obliged to pay (which i very much doubt), she will get a letter from the council saying so.

I feel for you, i used to live on a council estate, loved the house, location and cheap rent, but moved out due to people exactly like this girl of which you speak. Grrrr!

I am positive that she cannot do that. There is no way she can make someone contribute, if she wants to do the work then she has to pay herself

The only reason I am changing my fence is the old one is not that safe and looks a bit untidy now, the new one is costing over £1000! I have already told my neighbour I don't want him to contribute I just want it safe and secure but he is not happy as the new one is feather edge and the old one is panels! But the new one looks much better, I have even offered to buy all the wood treatment and do his side!

Great news, I just spoke to my Sister, the girl next door demanded an Inspector from the Council go round.....who's told her in no uncertain terms that it is her responsiblity and NOT my Sisters, she's overjoyed...

...serves her right, she was so sure she was in the right as well, and, has lost any chance of my Sister agreeing in the future....the Inspector has said, if she erects a fence and doesn't serve notice, my Sister can sue her.....ha ha!

If she'd been nice about it there wouldn't be a problem...

Thankyou all, and i have printed the 1978 Fencing Act off, just incase.....

thats very nice of u rosy ,, some people just like to cause trouble when there is no need for it .. one house i lived in me and my neighbour went halfs on the fence which they didnt have to as it was the left side ,, and they helped put it up as well ,, we both had young children and we wanted it to be safe ,, Big Grin
