If someone is asleep, there is no possible criminal intent. This is a matter which concerns me since I have frequent epileptic attacks, closely resembling sleep, but without collapsing. I have twice been found 'shoplifting' (but explained the position) and once, totally unconscious, went out for three hours shopping. The first I knew was when I found an unfamiliar carrier on the table and receipts inside I knew nothing about. I had paid - but without knowing a thing about it. Epilepsy and sleep have much in common. I've no idea what my legal position would be.

Well I am no expert but surely you should be in the same position as the sleepwalker as you have or an get medical evidence to support this.

I used to sleepwalk often but could never get out of the house, i am totally against violence yet a couple of years ago I punched my husband in the face whilst asleep, I have never thought too deeply into it all until this program came on.. my 10 year old son regularly argues in his sleep, lashes out & becomes violent if woken (he always has done)again I have never thought too deeply into this. it's definitly thought provoking... and a little worrying.

I watched it, it was really interesting.
I thought the court's decision of not guilty where that guy drove 14 miles accross a city and killed his mother inlaw was stupid though. It sounds a bit too complex to do in your sleep. :-/
I walk about a bit sometimes in my sleep I think, but nothing more than that and I talk as well.

Since I was quite young I've suffered from sleep walking and night terrors. For some reason though it doesn't happen in my house, only at my parents. One night I had a night terror and I was screaming so loudly that my parents woke up thinking someone had broken into the house and was attacking me. They then found me running around the house and feeling very confused. They are really horrible.
